SC/ST Act: Govt justifies amendment after court verdict

New Delhi:

Countering the Supreme Court’s view that the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act was being misused to frame innocent people, the Centre has told the apex court that discrimination against these communities continues to be “pervasive” as it justified the amendment to the law which overturned the court’s verdict to bar automatic arrest on any complaint. Expressing concern over the rampant misuse of the act, the SC had in March directed that there would be no automatic arrest without holding a preliminary inquiry and introduced the provision of anticipatory bail. But the Centre amended the law to nullify the verdict which had been challenged in the court.

Filing its response on a batch of petitions challenging the validity of the amendment, the Centre said law was amended to protect SC and ST communities, which continued to face discrimination and atrocities, and it was misleading to suggest that the act was being misused. It said there was no illegality in the amendment and the court should not entertain any plea against it as the law was changed in its discharge of constitutional obligations
