Taking cognizance of a plea filed by law student from a private university in Haryana for restraining him from entering the campus following a sexual harassment complaint against him, the Punjab and Haryana high court has issued notice to the university registrar.


The petitioner, who has been accused of sexually harassing his classmate during a foreign exchange programme in England, has pointed out legal infirmities into the constitution of sexual harassment committee of the university.

The petitioner has claimed that he was not given a fair chance to defend himself. The matter will now be heard by Justice R K Jain on Monday.

A group of students from the university had visited London in the third week of June this year under summer exchange programme with a foreign university.

The girl has accused the youth of making advances one night, when she went to his room for online browsing. The youth, however, has claimed that the girl complained against him because she felt slighted after he snubbed her in front of her classmates on some issue.

On returning to India in July, the girl had submitted a complaint before the university’s sexual harassment committee against the youth. On August 7, he was summoned by the university authorities and ordered to leave the campus immediately.

On August 24, the committee found him guilty and imposed several penalties including ban on entering campus till August 31. The girl filed an appeal against the decision seeking enhancement of punishment. On this, the university authorities on September 5 further enhanced the punishment, directing him not to enter the university campus till September 31.

According to the petitioner, he was informed by a professor that the complaint’s mother had told the university authorities that if the petitioner tendered a written apology, she would not pursue the allegations.

However, the petitioner refused to do so, terming it as a threatening tactic being employed by the girl and her family to pacify her ego.

The youth has claimed that he has been branded as an accused in the case without being given an opportunity to defend himself.

He has also alleged that the university did not form the sexual harassment committee according to the University Grants Commission regulations
