Chandigarh: Observing that both the Haryana Public Service Commission (HPSC) and Panchkula police dealt the alleged leakage of question paper for the examination for selection of assistant professors (Hindi) in a “casual manner“, the Punjab and Haryana high court has asked them to explain the reasons of inaction.
While direction both the DCP Panchkula and the secretary of HPSC to file an affidavit by August 25, HC made it clear that if they failed to give any explanation, both of them have to appear in person before HC on the next date of hearing.

The court was of the view that the allegation was correct or incorrect cannot be commented upon, but at least it should have been investigated into by the police.

HC has also clarified that the selection of the candidates for the post shall depend on the final decision of the present case.

“Despite the allegation that there was some evidence on the Whatsapp contained in the mobile phone of the candidate, strangely it is seen that no action at all has been taken by the police as regards the candidate. The matter seems to have simply been brushed under the carpet, or dealt with in a very casual and cavalier manner, by stating at the end of the DDR that no offence under the IPC was made out,“ observed Justice Amol Rattan Singh in his detailed order on the role of police.

Upset over the role of HPSC, Justice Singh observed that the allegation against the team deputed by the HPSC of casual frisking, also needs to be answered by the secretary of the commission.

The secretary has been directed to file personal affidavit explaining whether he has looked into the allegations of casual frisking, which would be otherwise available on the video cameras installed at the entrance of the examination hall.

Responding the allegations of leakage of the examination, HPSC, however told the court that those who were issued multiple roll numbers did not actually appear in the examination except against one roll number, with no other person having been found to have impersonated that person against the other roll numbers allotted, and no person shown to be absent having been declared to be selected.

The matter had reached before the HC in the wake of the petition filed by Rajeev Kumar, a resident of Bhiwani and several other candidates who had participated in the selection process.

The main allegation in the petition was that during the examination on February 26, 2017, several candidates entered in the examination centre at Doon School in Panchkula were not checked properly and one person was later found to be using mobile in which he was sending the questions to the paper solver on WhatsApp.

In February 2016, HPSC had advertised for selection of 112 posts of Assistant Professors (college cadre) in Hindi subject and final selection list was declared on August 9.
